SHC Deed Book 24 pages 289 & 290 - Deed of Bargain Sale - Peter Ferguson Wm & Benj Beal & James Maget

This Indenture made this 30th day of August A. D. 1838 between James Beale of the county of Southampton State of Virginia of the one part, William & Benjamin Beale and Peter Ferguson of the second part all of the county of Hertford & state of North Carolina and James Maget of the third part. Witnesseth that for and in consideration of one dollar in hand paid by the said James Maget to the said James Beale at and before the unsealing and delivery of these presents the receipt whereof is hereby acknowledged he the said James Beale hath this day bargained and sold and by these presents doth bargain and sell alien & convey to the said James Maget the following named property. (To Wit) Two feather beds one clock one chest & chairs one pine table & balance of household & kitchen furniture one horse one ladder two ___ & thirteen pigs & ___ of farming utensils and two thirds of the growing crop of corn fodder & cotton on the place wherein said James Beale lives. To have and to hold the above named articles of property or personal estate to him the said James Maget his heirs and assigns forever. Interest nevertheless and for the following purposes to wit, whereas the said William Beal & Benj Beal are jointly bound as security for the said Jas Beal in a bond dated the 23rd day of June 1838 payable to Geoge Powell for the su of fifty nine dollars & 96 cts. And also the said James Beal is indebted to said Peter Ferguson in the sum of fifty five dollars by note dated this 30th day of August (inst) with interest from the first day of February last ___ to secure harmless the said William & Benjamin beal and to secure the paymt of the amount due to said Peter Ferguson and if the said James Beal fails to pay or cause to be paid to the said George Powell…..

 And Peter Ferguson the amt above specified on or before the 1st day of Dec next together with the interest _____may then be due thereon,  the said James Maget is hereby authorized empowered & directed at any time after he said 1st day Dec next upon the request of the said Williams or Benj Beal or Peter Ferguson or either of them or their assigns to advertise the said before named articles of property or any part thereof for the term of ten days and at the expiration of that term to sell at public auction the said property so identified to the highest bidder for cash and the proceeds of said sale to be applied to the paymt of said debts & interest so ___ ___, and if the proceeds of said sale shall ____ then pay the debts & interest of the reasonable charges & expenses of said Trustee then the ___ ___ be pd. To the said James Beal his Execs or assigns. In witness whereof we have hereunto set our hands & seals and dated as above.

SOUTHAMPTON COUNTY COURTHOUSE

COURTLAND, VIRGINIA

 

 

This Indenture made this 14 day of October 1843 Between Peter Fergason of the County of Southampton and State of Virginia of the first part Cordy D. Bishop and Anthony M Howell of the same county and state of the other part. Witnesseth that said Anthony M. Howell in order to secure the payment of a certain debt due by note and owing to said Anthony M. Howell for the sum of sixty one dollars and ninety three cents and hearing date the 6th of January 1843 he the Peter Ferguson at or before the sealing and delivery these presents the rite whereof is hereby acknowledge he the said Peter Ferguson hath granted bargained and sold by these presents such grand bargain and sell unto the said Cordy D. Bishop his heirs Executors or administrators all the right title interest claim and demand the said Peter Ferguson now or may hereafter have in and to all of my interest both real & personal in David Howells Estate also the property now in my possession (Viz) Two feather Beds 3 head cattle and household and kitchen furniture the said Peter Ferguson doth convey the property above mentioned to the said C.D. Bishop to secure Anthony M. Howell in the above amount of money to which I do warrant & defend all rights titles & claims to the said C.D. Bishop to secure the payment above mentioned the said C.D. Bishop shall at any time gave ten days Notice & sell at public auction the property for cash to satisfy the debts of A.M. Howell & the manner if any to be paid to to the said Ferguson or his heirs and if the Peter Ferguson shall pay the aforesaid debt with interest that may accrue when required by the said A. M. Howell or his assigns then the said C.D. Bishop shall release to the said Peter Ferguson all the right title in him conveyed and the said Peter Ferguson for himself his heirs Executors administrators shall will and do warrant and forever defend the right & title of said property above mentioned against the claim or claims of all and every person or persons whatever signed.

This Deed of Trust Between Peter Ferguson of the first part Anthony M. Howell & Cordy D. Bishop of second part was acknowledged by all parties thereto and admitted to record.

This Indenture made the twenty second day of June in the year of our Lord one thousand eight hundred forty six between Peter Ferguson and wife Mary Ann of the county of Southampton and state of Virginia of the one part and John B Jenkins of the same county and state of Virginia of the other part. Witnesseth that the said Peter Ferguson and his wife Mary Ann for and in consideration of the sum of one hundred and fifty dollars to them in hand paid by the said John B Jenkins at or before the unsealing and delivery of these presents the receipt whereof is hereby acknowledged. He the said Peter Ferguson and his wife Mary Ann hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John B Jenkins his heirs and assigns all of our right and interest in @ tract of land in which David Howell dec'd seized and possessed it being _____ land and and hired from said David Howell dec'd by the said Peter Ferguson and his wife Mary Ann and adjoining the lands of the said John B Jenkins Hardy Cross and by the Black Water river it being one sixth part of the above parcel tract of land with all singular reversion and reversions remainder and remainders and other ____ _____ and profits thereof and every part and parcel thereof. To have and to hold all of our right and interest in said tract of parcel of land with the hereditament and hereditaments with all and singular ____ the promises and appurtenances before mentioned unto the said John B Jenkins his heirs and assigns and all and every other person or persons whosoever the said Peter Ferguson and his wife Mary Ann their heirs and assigns those will and do by their personal forever warrant and defend the right and title unto the said John B Jenkins his heirs and assigns.

In Witness whereof the Peter Ferguson and Mary Ann his wife hereto ____ set their hands and seals this day and year at first above written.

Southampton County to wit: We Jesse Parker and Henning T Smith Justice of the Peace in and for the county aforesaid and state of Virginia do hereby certify that Mary Ann Ferguson the wife of Peter Foggerson parties to a certain deed having date the twenty second day of June one thousand eight hundred and forty six and hereunto examined personally appeared before us in our County aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her, she the said Mary Ann Foggerson acknowledged the same to be her act and deed and _____ that she had willingly signed sealed and delivered the same and that she wished not to retract it. Given under our hands and seals this 22nd day of June 1846.

Southampton County in the Clerks Office the 20th day of July 1846.

This Deed of Bargain and Sale from P Ferguson and wife to John B Jenkins was presented by the oaths of H. T. Smith and Jesse Parker two of the witnesses thereto as to said Peter Ferguson one of the prties thereto . And on the 19th day of October 1846 was also proved by the oath of Littleton Moore the other witness thereto as tot he said Peter Ferguson and together with the certificate of the ______ examination and acknowledgement of the ____ admitted to record.
