GATES COUNTY DEED BOOK 14 PAGE 281

This Indenture made the 19th day of February in the year one thousand eight hundred and thirty one between Jethro Sumner of Nansemond County and State of Virginia of the first part and David Howell of the County and State aforesaid of the other part witnesseth that the said Jethro Sumner for and in consideration of the sum of one hundred dollars to him in hand paid by the said David Howell at or before the unsealing and delivery of these presents, the receipt whereof is acknowledged he the said Jethro Sumner hath granted, bargained & sold, and by these presents do grant bargain & sell unto the said David Howell, his heirs & assigns forever the one half of that seine place or fishery ( called & known bt the name of the Dowery), with two acres of land thereunto adjoining lying & being in Gates County in the State of North Carolina and on Chowan River. The reversion & reversions, remainder & remainders yearly & other rents issues & profits thereof and every part and parcel thereof. To have and to hold the said moiety of the seine place or fishery and land adjoining aforesaid unto him the said David Howell & his heirs & assigns forever and the said Sumner for himself & his heirs the said moiety of seine place or fishery and land aforesaid with the premises & appurtenances before mentioned unto the said David Howel his heirs & assigns forever, free from the claim of him the said Jethro Sumner his heirs & assigns and from the claim or claims of all & every other person or persons whatsoever shall, will & do warrant & forever defend by these presents. In witness whereof the said Jethro Sumner hath hereunto set his hand and seal the day and year as first above written.

This Indenture made the 14th day of October in the year one thousand eight hundred and thirty five between Edward Howell of Nansemond County Virginia of the one part and David Howell sent. Of said County & State aforesaid of the other part. Witnesseth that the said Edward Howell for & in consideration of the sum of one hundred and fifty dollars to him in hand paid by the said David Howell sent. at or before the unsealing and delivery of these presents the receipt whereof hereby acknowledged he the said Edward Howell hath granted, bargained & sold and by these presents doth grant, bargain & sell unto the said David Howell sent. his heirs or assigns a certain tract or parcel of land lying & being in Gates County, State of North Carolina near Wain Oak Ferry. Beginning in Somerton Creek in the State line thence due west along said line to a short leaf pine, corner for Dempsey Howell & Edward Howell, thence a South course along a line of marked trees to a pine stump on the Wain-Oak road, thence up the road to the foot of a called the Henry Jones path, thence along said path to a pine at the bend of said path, thence a straight course to Sumerton Creek, thence along said Creek, its various courses to the first station, containing one hundred and seventeen acres be the same more or less, the reversion & reversions, remainder & remainders, yearly & other rents, issues & profits thereof and every part & parcel thereof. To have and to hold the said tract or parcel of land with the tenements, hereditaments and all & singular other the promises & appurtenances before mentioned or intended to be bargained & sold, and every part & parcel thereof, with every of their rights members & appurtenances unto the said David Howell sent. his heirs & assigns forever and the said Edward Howell for himself & his heirs, the said tract or parcel of land, with all & singular the promises & appurtenances before mentioned unto the said David Howell sent. his heirs & assigns and of all & every other person or persons whatsoever, shall will & do warrant & forever defend by these presents. This Indenture made the tenth day of April in the year one thousand eight hundred and forty between Anthony M. Howell & Emma his wife of Southampton County state of Virginia of the one part & David Howell (sen.) of Nansemond County state of Virginia of the other part. Witnesseth that the said Anthony M Howell & Emma his wife for an in consideration of the sum of nine hundred dollars to them in hand paid by the said David Howell (sen) at or before the unsealing of these presents the receipt I do hereby acknowledge, have bargained, and sold by these presents do and each of them doth bargain and sell unto the said David Howell (sen), his heirs and assigns a certain tract of land lying and being in the Southampton County containing one hundred and twenty acres more or less marked and bounded as follows~~~ Beginning at or near a spring on Blackwater River joining Seth D Williams, some spaces up the river from the P&R R.Road warehouse; thence down said River to a marker line of Seth D Williams line thence along the said Williams line to a corner of Hardy Cross or others; thence along said line or lines of marked Trees to said Seth D Williams line thence along said Williams line to the first station together with all and singular the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof and of every part and parcel thereof. To have and to hold the said tract of Land with the tenements hereditaments and all and singular other the promises herein mentioned and intended to be bargained and sold and every part and parcel thereof and every of their rights members and appurtenances unto the said David Howell (sen) his heirs and assigns forever the said Anthony M. Howell and said Emma his wife for Themselves and their heirs the said tract with all and singular the promises and appurtenances before mentioned unto the said David Howell (sen) his heirs and assigns free from Claim or Claims of them the said Anthony M Howell and Emma his wife or either of them their or either of their heirs and of all and every person or persons whatever shall will and do warrant and forever defend by these presents. This Indenture made this 25th day of December in the year of our Lord one thousand eight hundred and forty between Seth D. Williams and wife Martha of the county of Southampton and state of Virginia of the one part and John B Jenkins of the county of Nansemond and state of Virginia of the other part. Witnesseth that the said Seth D Williams and wife Martha for and consideration of the sum of two thousand dollars to them in hand paid by the said John B Jenkins at ot before the unsealing and delivery of these presents the receipt whereof is hereby acknowledged to the said Seth D Williams and wife Martha hath granted bargained and sale and by these presents doth grant bargain and sell unto the said John B Jenkins a certain tract or parcel of Land laying and being in The County of Southampton and state of Virginia known as the lands (at Franklin Depot) and bounded East by the black water River and on the North by the lands of Jesse Langford and George Kemp and on the west by the lands owned by the heirs of Uriah V Gardner to a pine marking a corner tree between the heirs of Mary Whitfield Uriah V Gardner and Seth D Williams thence along a line of marker trees to Hardys Cross line to a dead pine stump marking a corner tree between Hardy Cross and Seth D Williams thence running nearly a South course by the lands of Hardy Cross and David Howell to a small Dogwood marking a corner tree between Seth D Williams and David Howell thence to and bounded by the black water River to the first station containing one hundred and eighteen acres be the same more or less with all and singular the reversion and reversions remainder and remainders yearly and other rents ___ and profits thereof and every part and pared thereof. To have and to hold the said tract or parcel of Land with the testaments hereditaments and all singular ___ the premises and appurtenances before mentioned unto the said John B Jenkins his heirs and assigns and all and every other person or persons forever warrant and defend the rights and Title unto the said John N Jenkins his heirs and assigns. Know all men by these presents that I Lemuel Britt of Hertford County N. Carolina hath this day sold unto Abram Riddick of the same County and state for the sum of two hundred dollars all my right Interest __ to and in the Estate of David Howell of Southampton County Va the father of my wife, the receipt of the said sum of two hundred dollars for the premesis & I do hereby acknowledge and do for myself and my heirs warrant and defend the said Riddick and I empower him to sue for and ____ said interest (if necessary) for his own use and benefit. Intestimony of the above I have caused my seal to be made & made my mark the day and year first above written.

This Indenture made the first day of December in the year of our Lord one thousand eight hundred forty two between Joseph S Summers of Nansemond County, Willis W Lawrence of Southampton County, Samuel Carson & Elbert Vaughn & Caroline his wife of Isle of Wight County in the state of Virg* all of one part and Seth D Williams of the county of Southampton aforesaid of the other part. Witnesseth that for and in consideration of the sum of Fifty dollars to them in hand paid by the said Seth D Williams at and before the unsealing and delivery of these presents the receipt whereof is hereby acknowledged they the said Joseph Joseph S Lawrence Willis W Lawrence Samuel Carson & Elbert Vaughn & wife as the heirs and distributors of George W Lawrence ___dec'd have granted bargained and sold and by these presents to grant bargain and sell unto the said Seth D Williams his heirs and assigns two certain lots or parcels of land lying on each side of black water river and bounded thereby the one lying in the aforesaid county of Southampton & the other in the aforesaid county of Isle of Wight and connected by the aforesaid river and lying directly opposite each other and containing seven acres more or less and adjoining the lands belonging to the heirs of David Howell dec'd on the west and Willis Elay on the east together with all and singular the reversion and reversions remainder and remainders yearly and other ___ ___ profits thereof and every part and parcel thereof. Susannah Howell and Wm Murfee

This Deed made This 16th Day of April A.D. 1852 between Susanah Howell of Hertford County, NC and Wm Murfee of Southampton County, VA Whereforth. That the said Susanah Howell do promise unto the said Wm Murfee his heirs, administrators, (abbrv) Executors (abbrv) or assigns all of her devine right in the tract or parcel of land at or near Franklin Depot in the county of Southampton, Va. Whereon David Howell, her late husband “decd” seized and possessed from the 1st day of January 1853 for the term and during her (the said Susanah Howell’s) life to hold to his and his heirs, administrators (abbrv) for proper use for which the said Wm Murfee promises to pay her fifty dollars lawfull money to be paid at the end of each year as the amount of rent becomes due. Nevertheless the said Wm Murfee is to all on Robt G. Edwards to retain possession of land till the 1st of January 1855 he having leased the same for the term of Three years commencing the 1st of January 1852 at the price of fifty dollars and the said Robt G Edwards pay to the said Wm Murfee amounts of fifty dollars for his rent annually as it becomes due for the years 1853 and 1854 and the receipt of the said Wm Murfee will be good for the same. Witness our signatures and seals.

This Deed made this 4th day of October 1880 between Junius W. Edwards of the county of Southampton State of Virginia of the first part, grantor and A. L Gardner of the same county and State of the second part chosen as trustee, wittnesseth: That the said Junius W. Edwards doth grant and convey for the purpose of securing one debt due John Pretlow, Jr. with General Warranty unto the said A. L. Gardner the following real property to wit: a certain parcel a lot of land lying in the town of Franklin and bounded as follows:

Beginning at a white oak a corner of this tract and the lands of which David Howell died seized and possessed, thence S 29 degrees E 32p, along the line between this tract and the aforesaid land across the road to a small pine bush, thence S 58 degrees W 25p along a new line of marked trees to a small white and a red oak bush, a corner of this tract thence N29 degrees W 32p along another new line of this tract to a white oak bush and a red oak bush another corner in this tract in the line of John B. Jenkins

thence W 58 degrees E 25p along the line between this tract and the said John B. Jenkins to the beginning containing by survey Five acres it being the land conveyed by Indenture dated 10th day of April 1846 made and executed between Hardy Cross and martha his wife and Robert G Edwards and to said Indenture reference is hereby made for same description s is here made. This tract is the same of which the said Robt. G. Edwards died seized and possessed, and on which the said Junius W. Edwards resides. This conveyance is made IN TRUST to secure the above mentioned debt and amounting to Eight Hundred Dollars bearing interest from the date and due on demand unto John Pretlow, Jr. on order. And should the said J. W. Edwards make default in payment of said Bond, then it shall be the duty of said Trustee on receiving notice from said Pretlow or his legal representative to advertise said real property for sale for the period of 30 days in two or more places in Southampton County after which he shall sell said land for cash to the highest bidder and after deducting all legal expenses from the proceeds of said sale together with 5 per centum to said Trustee he shall pay unto the said Pretlow the amount of his Bond secured by this deed and there pay the remainder of said proceeds to the said J. W. Edwards or to his order. Witness the following signatures and seals.
