David Howell
Biography
It is believed that David Howell was born circa 1775. He was married to Susannah March. Evidence suggests that David Howell had a close relationship with John March who (we believe) is Susannah's father. David Howell was also listed as an heir to John March's pension. David owned property in what is now Franklin, Virginia somewhere around what was known as Franklin Depot along The Blackwater River. David Howell died sometime in December of 1842. He had no Will and there were law suits filed in Southampton County court regarding his estate. It appears that he made his living as a fisherman. An inventory of his property after his death indicates he had nets, hooks, and equipment that would have been used by fishermen at that time. David and Susannah had six children. There is also a mention in the Southampton County Court Order Book of a Nelson Howell who is described as "an orphan child of David Howell". There are two separate entries in The Southampton County Court records that mention Nelson Howell as an orphan child of David.
Census records indicate that Susannah (or Susan as it was in the record) moved to Hertford County, NC after her husbands death and was found living with her son Robert S. Howell in 1850. It is believed that Susannah died in 1865 and is buried in the Taylor Family Cemetery along the back fence on Parkers Ferry Road in Como, N.C. One of David’s sons (Edwin) is buried there along with four of his grandchildren. We are still trying to find more about David and Susannah and the orphan child Nelson as our research continues.

On the 12th day of May 1834 personally appeared before Josiah Riddick, James Corbede, Howell Riddick, Harland E. Pope the court of Nansemond now sitting, John A. March, a resident of the aforesaid County and state, aged 38 years, who being first duly sworn, according to law, doth, on his oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress, passed June 7th, 1832 ~ That in the year 1777 or 1778, his father John March, as he has often heard him say, enlisted in the Army of the United States, under Captain John Washington, and served two years under that officer on the Continental line; that he frequently heard his father speak of Gen'l Washington and Gen'l Lafayette; that he has heard his father say he enlisted under Capt John Washington, as a Private, for the term of two years, at Suffolk, Virginia,

and that he served the term of two years on the Continental line and was honorable discharged at the expiration of his term of enlistment ~ that his father resided in the county of Nansemond and state of Virginia when he entered the service, as he has heard him say~that he has heard his father speak of being in sevral battles, but does not now was that the name ~ that he has heard him speak of being engaged in a battle in the state of New Jeresy and that he performed the principle part of this term of service at the north ~ that when he returned from the north, having served two years in the Continental line, he again entered the service of the United States, he thinks in the militia and served until the Capture of Cornwallis at Little York, and was at or near that place at the time the battle was fought.
He hereby relinquishes every claim what - was to a pension or annuity, or account of his father's services during the Revolution,except the present, and declares that his

fathers name was not on the Pension Roll of the Agency of any State ~

And the said court do hereby certify, upon satisfactory evidence, that the said John March died on the 22nd day of April 1832.

The Court certified at the same time that a John A. March made the declaration that his father John March died on the 22nd April 1832 ~
I also enclose herewith a copy of the evidence upon which John March was allowed county land and the certificate of the Register that he _____ a warrant to the heirs.
The name of John March will be found upon the Virginia Continental Register, and it will be seen that his certificate of pay was drawn by Willis Riddick in 1784, who was then a member of the Assembly from this County. ~ ___ of this, if it be necessary to ___ the heirs to the trouble and expense, I know they can obtain the

widower of more than half a dozen persons now living in the county, that John March was a Continental soldier, and that his first term of service in that line war for two or three years. ~ The widower of Henry Harrison, (the presiding Justice of this county,) however, I presume will be amply sufficient in this case, together with the hard evidence of the services of this revolutionary soldier.

David Howell, her late husband “decd” seized and possessed from the 1st day of January 1853 for the term and during her (the said Susanah Howell’s) life to hold to his and his heirs, administrators (abbrv) for proper use for which the said Wm Murfee promises to pay her fifty dollars lawful money to be paid at the end of each year as the amount of rent becomes due. Nevertheless the said Wm Murfee is to allow Robt G. Edwards to retain possession of land till the 1st of January 1855 he having leased the same for the term of Three years commencing the 1st of January 1852 at the price of fifty dollars and the said Robt G Edwards pay to the said Wm Murfee amounts of fifty dollars for his rent annually as it becomes due for the years 1853 and 1854 and the receipt of the said Wm Murfee will be good for the same. I Susana Howell of the County of Hertford & State of North Carolina being of sound mind & memory but considering the uncertainty of my earthly existence do make and declare this my last Will and testament in manor and form following That is to say first that my Executors hereinafter named shall provide for my body A decent burial suitable to the wishes of my relations and friends and pay all funeral expenses, together with my just debts howsoever and whomsoever owing out of the money that may first come in his hands, as A part of my estate, First. Item. I give and bequeath to my Daughter Ann Maria Britt wife of Lemuel Britt the sum of Two dollars, to her and her heirs forever. Item I give and bequeath to my Daughter Mary A. Susannah Howell and Wm Murfee
This Deed made This 16th Day of April A.D. 1852 between Susanah Howell of Hertford County, NC and Wm Murfee of Southampton County, VA Whereforth. That the said Susanah Howell do promise unto the said Wm Murfee his heirs, administrators, (abbrv) Executors (abbrv) or assigns all of her devine right in the tract or parcel of land at or near Franklin Depot in the county of Southampton, Va. Whereon David Howell, her late husband “decd” seized and possessed from the 1st day of January 1853 for the term and during her (the said Susanah Howell’s) life to hold to his and his heirs, administrators (abbrv) for proper use for which the said Wm Murfee promises to pay her fifty dollars lawfull money to be paid at the end of each year as the amount of rent becomes due. Nevertheless the said Wm Murfee is to all on Robt G. Edwards to retain possession of land till the 1st of January 1855 he having leased the same for the term of Three years commencing the 1st of January 1852 at the price of fifty dollars and the said Robt G Edwards pay to the said Wm Murfee amounts of fifty dollars for his rent annually as it becomes due for the years 1853 and 1854 and the receipt of the said Wm Murfee will be good for the same. This Deed made this 4th day of October 1880 between Junius W. Edwards of the county of Southampton State of Virginia of the first part, grantor and A. L Gardner of the same county and State of the second part chosen as trustee, wittnesseth: That the said Junius W. Edwards doth grant and convey for the purpose of securing one debt due John Pretlow, Jr. with General Warranty unto the said A. L. Gardner the following real property to wit: a certain parcel a lot of land lying in the town of Franklin and bounded as follows:
Beginning at a white oak a corner of this tract and the lands of which David Howell died seized and possessed, thence S 29 degrees E 32p, along the line between this tract and the aforesaid land across the road to a small pine bush, thence S 58 degrees W 25p along a new line of marked trees to a small white and a red oak bush, a corner of this tract thence N29 degrees W 32p along another new line of this tract to a white oak bush and a red oak bush another corner in this tract in the line of John B. Jenkins

thence W 58 degrees E 25p along the line between this tract and the said John B. Jenkins to the beginning containing by survey Five acres it being the land conveyed by Indenture dated 10th day of April 1846 made and executed between Hardy Cross and martha his wife and Robert G Edwards and to said Indenture reference is hereby made for same description s is here made. This tract is the same of which the said Robt. G. Edwards died seized and possessed, and on which the said Junius W. Edwards resides. This conveyance is made IN TRUST to secure the above mentioned debt and amounting to Eight Hundred Dollars bearing interest from the date and due on demand unto John Pretlow, Jr. on order. And should the said J. W. Edwards make default in payment of said Bond, then it shall be the duty of said Trustee on receiving notice from said Pretlow or his legal representative to advertise said real property for sale for the period of 30 days in two or more places in Southampton County after which he shall sell said land for cash to the highest bidder and after deducting all legal expenses from the proceeds of said sale together with 5 per centum to said Trustee he shall pay unto the said Pretlow the amount of his Bond secured by this deed and there pay the remainder of said proceeds to the said J. W. Edwards or to his order. Witness the following signatures and seals.

"Agreeably to the above decree I have proceeded to sell at public auction the reversionary interest in the parcel
of land of which David Howell dec'd seized and possessed lying on Black Water river at the R. R. warehouse
between the County road and John B. Jenkins land supposed to contain five acres more or less and John B. Jenkins became the purchaser for $400.00.
I have deducted for charges to wit: Lawyers fee $10.00

Comm on 300 5 ps of 100 @ 2 1/2 per 17.50
Six bonds each $61.68 2/3 370.12 $400.00
For which balance I have taken six equal bonds $11.18 2/3 each with security. All of which is herewith respectfully submitted – June 1846. Your complainant
Robert G Edwards humbly shows that some years since David Howell of the county of Southampton departed this life in testate having a widow Susannah Howell and the following heirs of his body, to wit; Anthony M Howell, Robert Howell, Edwin Howell, Lemuel Howell, Ann Maria Howell who has intermarried with Lemuel Britt and Mary Ann Howell who has intermarried with Peter Ferguson; and that a tract of land lying in the county of Southampton containing about five acres was assigned to the said Susannah Howell as a part of her claims in the estate of her deceased husband David Howell; that the said tract of land lying on Blackwater river is bounded as follows: to wit; beginning at a chinquapin stump near the South East corner of the Bait Band warehouse at Franklin on the bank of the Blackwater river, thence to the county road, and along the said road across the run of the branch to Col. Hardy Cross line; thence along the said Col. H Cross line to Jno B. Jenkins line thence along the said Jno B. Jenkins line to the Blackwater river, thence down the said river along the various courses thereof to the beginning.
Your complainant would further state that some short time since he purchased the life estate of Susannah Howell in the said tract of land as willfully appraised by the deed of conveyance enter to by the said Susannah Howell to him and now of record in the Clerks office of the county of Southampton and under this purchase he is now in possession of the said tract of land; and that at the same time he purchased the reversionary interest of Edwin & Lemuel Howell and of Peter Ferguson & his wife Mary Ann, as will appear by the deed executed by the said parties to him and entered of record in the Clerks office of the said county of Southampton and that he is now entitled to the whole of the said land during the life of Susannah Howell and to one half of the estate in remainder after her death; he states that the reversionary interest of the heirs is now and always worth very little, and that it would be to the mutual advantage of all interested that the reversionary
estate, that is the estate in remainder after the death of the said Susannah Howell in the said land should be sold. Your complainant is advised that he can come into their worshipful court and pray a sale of the said estate in remainder and a distribution of the proceeds of sale among the parties interests according to their respective rights, that is among your complainant, Anthony M. Howell, Robert Howell, and Lemuel Britt & his wife Ann Maria.
In consideration of the promises and in as much as your complainant is without remedy at law, he prays that Anthony M. Howell, Robert Howell, Lemuel Britt & Ann Maria his wife, he made parties deft(sic) to this bill: Your complainant prays the usual writ of subpoena and as is duty bound will ever pray. The answer of Anthony M. Howell, Robert Howell, and Lemuel Britt & Ann Maria his wife---- These defts (sic) saving & for answer to the said above bill, say that they believe the parts contained in the said bill are true, and that a sale of the estate in remainder and a proper distribution of the proceeds would be to the interest of those entitled, and having answered pray siner to be dismissed the court.

This day this cause came on to heard by consent in the bill and answer and was argued by council on consideration where of the court doth order, adjudge, and decree that Allen Edwards who is hereby appointed a special commissioner of this court after adjusting the time and place of sale for ten days at the courthouse and two or more publick (sic) places in the vicinity of said land described in the bill, proceed to sell the said reversionary interest in the said land after the death of the said Susannah Howell, to the highest bidder, and that he resume so much in cash as will pay the expenses of this decree and for the balance of the proceeds of sale he take s?? equal ?inds with the good security payable in six months and return there to this court in order for a final decree.
Received July 10, 1846 of the Clerk of Southampton County Three of the bonds assumed by the Commissioner in due Cause amounting to sixty one 68 2/3/100 each being my proportion of the sales.
