Wiliams and the executor therein named who made oath and together with Anthony M. Howell and Thomas Lawrence his securities entered into and acknowledged a bond in the penalty of Two Hundred dollars conditioned as the law directs. Certificate is granted him for obtaining a probate thereof in due form.

Howell and Jethro Cobb his securities here in Court so verbally acknowledged themselves indebted unto John Rutherford Esq., Lieutenant Governor acting as Governor of the Commonwealth of Virginia that is to say the said William Howell in the sum of Two hundred dollars and the said Anthony M. Howell and Jethro Cobb in the sum of One hundred dollars each of their respective goods and chattel lands and Tenements to be levied and to the said acting Governor and his successors in the office of Governor to the use of the Commonwealth rendered. This day came the plaintiff by his attorney and it appearing to the court that the defendents have had legal notice of this motion they were solemly called but came not. Therefore it is considered by the Court that the plaintiff may have execution against the defendants for One hundred and twenty four dollars and ninety four cents the penalty of the said bond and his costs by him in this behalf expended. And the said defendants in Mercy _____
But this execution may be discharged by the payment of sixty two dollars and forty seven cents with legal interest thereon from the 15 day of July 1841 till paid and the costs.

The defendant Eli Joyner who is out of this Commonwealth and against whom the plaintiffs seem to have proceeded in the mode presented by law against absent defendants having failed to appear and file his answer the bill of the plaintiffs is taken for confessed as to him: and the other defendants on whom the subpoena seems to have been executed and the bills of the plaintiffs filed more than four months and they having failed to comply and file their answers-and the several Scire facias in the cause having been regularly executed and yet on appearance made for the defendants the bill of the plaintiffs is taken for confessed as to all the Defendants.This cause came on to be heard on the original and amended bills whereto filed and was argued by Counsel. On consideration whereof the Court doth adjudge, order, and decree that the aforesaid Eli Joyner pay to the plaintiff Jason Butler seventy one dollars and sixteen cents with interest thereon from the 22nd day of November 1837 till paid, and that he pay to Anthony M. Howell one of the plaintiffs the sum of One hundred and sixty two dollars and eighty cents with interest theron from the 20th day of January 1834 till paid, and that he pay to the plaintiffs the costs in this suit expended. And the Court doth further order...

that the Clerk of this Court deliver to the plaintiffs or their attorney a bond filed by the Commissioners on the suit of Whitehead & wife against Joyner in this Court payable to James D Masenburg, James Scott and Jordan Edwards for fifteen dollars 54 8/17 cents due 9th January 1837 and executed by A. M. Howell and gray Edwards to be paid in part Satisfaction of the debt due to the said Jason Butler and that the Sheriff of this County sell to the highest bidder for cash ___ of the estate in the possession of Honor Daughtrey or her Committe to which she is entitled for her life under the will of THomas Daughtery and which one seventh part by the will of said Thomas Daughtrey belongs on the death of the said Honor Daughtrey to Charlotte Daughtrey who married Hillyard Holland and which one seventh has become the property of said Eli Joyner in remainder and out of the proceeds thereof pay first the costs of this suit and pay the amount due the plaintiffs after the application of the aforesaid bond-and the balance if any the Sheriff shall bring into COurt subject to the further order of this suit- But if the whole fund now decreed awards the satisfaction of the plaintiffs demands shall not be enough to discharge the same, then they shall be paid retrubly-But the plaintiffs are not to have the benefit of this decree until the plaintiffs or one of them or same one for them shall have filed in the Clerks Office of this COurt bond with good security in double the amount of their respective claims conditioned to to abide such further order as may be made for returning the effects of the absent defendant upon his appearance and answering the bill of the plaintiffs. But on such sale shall be made unless upon at least thirty days notice of the time and place of sale nor unless the Defendant Eli Joyner shall fail to pay the plaintiff for thirty days thier respective demand aforesaid together with the costs of this suit.

Matthew Mountford who stands bound by recognizance for his appearance here to answer the complaint of Baldy Mountford against him for a breach of the peace this day appeared in discharge of his recognizance and the said Baldy Mountford being sworn and examined and the said Matthew Mountford being fully heard it is the opinion of the Court & accordingly ordered that the said Matthew Mountford and do find scrutiny for keeping the peace for the term of 12 months from this day the said Matthew Mountford to be bound on a recognizance in the sum of $20 with two securities in the sum of $10 each and that he also pay the costs of this prosecution whereupon the said Matthew Mountford with Anthony M. Howell & Feilding I. Mahone his securities herein court severally acknowledge themselves indebted onto John M. Gregory Lieutenant Governor acting as Governor of the Commonwealth of Virginia that is today the said Matthew Mountford in the sum of $20 and the said Howell & Mahone in the sum of $10 each of their respective goods & chattel lands tenements to be levied & to the said Lieutenant Governor acting as Governor and his successors in the office of Governor to the use of the Commonwealth rendered. Yet upon this condition that if the said Matthew Mountford shall keep the peace & be of good behavior towards all the citizens of this Commonwealth more especially towards the said Baldy Mountford for the term of twelve months from this day then this recognizance to be void.
