Biography

 

Anthony March Howell was the 1st son and the first child of David and Susannah Howell. His name appears in several court documents in Southampton County Courthouse. It is believed that most of his activities dealing with the court has been as a bail bondsman. He has provided "securities" as part of lawsuits and wills. He has also been a sheriff's deputy and a constable. He has been a plaintiff as well as a defendant in many suits in Southampton County. It is anticipated that more information will be found about him. It has been documented that he separated and later divorced from his wife Emily (aka Emma). Anthony married Emily Joyner (1815-1849). Court documents are currently being transcribed and will be posted periodically.

 


Marriage Record

Anthony March Howell and Emily Williams Joyner were married on August 19, 1830 in Gates County, North Carolina. Emily (sometimes referred to as Emma) was married to a Williams prior to Anthony. Emily’s first husband died and she became a widow prior to 1830.

Saunders are held and firmly bound unto John Owen Esquire

Governor of the state aforesaid in the sum of five hundred pounds

current money of this State to be paid to the Governor his successors

or assigns to which payment will & truly to be made.

We bind ourselves our heirs, executors, administrators, and assigns

jointly & severly firmly by these presents. Sealed with our seals

and dated the 19th day of August Anno Domini 1830______ _______ ______

The condition of the above obligation is such that whereas the

above bounder Anthony M Howell hath made application

for a license for a marriage to be celebrated between

him and Emily Williams - - resident of this county. Now

if it shall not appear hereafter that there is any lawful

cause to obstruct the said marriage then the above obli-

gation to be void otherwise to remain in full force & virtue.

This Indenture made the 22nd day of February in the year of our Lord 1831 between Anthony M. Howell and Emmy Howell his wife of the county of Southampton of the one part and Dempsey Blythe of the county aforesaid of the other part. Witnesseth that the said Anthony M. Howell for and in consideration of the full and just sum of two hundred and seventy five dollars current money of Virginia to be paid by the said            to them in hand on or before the unsealing and delivery of these presents the receipt whereof the said Anthony M. Howell and Emmy his wife doth hereby acknowledge and therefore acquit and discharge the said Dempsey Blythe his heirs and assigns forever and thereafter to be fully and eternally satisfied contented and paid have _____ bargained sold ____  _____ ___ and by these presents do grant bargain sell a lien ___ release set over deliver, confirm unto him the said Dempsey Blythe and to his heirs assigns forever all that plantation ___ _____ tract and parcel of land wherein the said Dempsey Blythe now lives on being the tract __ purchased of Anthony M. This Indenture was acknowledged by Anthony M. Howell and together with Certificate thereto ____ of the ____ ___ and relinquishment of ____ of Emmy Howell wife to the said March Howell parties thereto admitted to record. And at a court held for the County aforesaid the 17th day of March 1834. The said Indenture and Certificate were returned upon the proceedings of the day.

This Indenture made this 26th February Eighteen hundred and thirty four between Dempsey Blythe of the County of Southampton of the one part Anthony M. Howell of the said County of the other part and Thomas C. Jones of the aforesaid County of a third part. Witnesseth that whereas the said Dempsey Blythe ___ and ___ by a Bond to the said Anthony M. Howell in the sum of two hundred and seventy five dollars and whereas for the further assurance of the payment it is agreed by the parties hereunto that a conveyance in trust shall be made to the said Thomas C. Jones for the benefit of the said Anthony M. Howell in case the said Bond shall ___ ___ ____ paid with lawful interest thereon on or before the first day of May 1834. Now this Indenture Witnesseth that the said Dempsey Blythe for and in consideration of the promises and for the further sum of two hundred and seventy five dollars to him in hand paid the receipt of which is acknowledged has bargained and sold and by these presents doth for himself his heirs Executor and administrators give grant bargain and sold unto the said Thomas C. Jones his heirs and assigns all that tract or parcel of land tow horses & cart and wheels whereon the said Dempsey Blythe now pr___ lying in the said county of Southampton containing by estimation seventy five acres be the same more or less and bounded by the known and reported ___ thereof and also all the buildings ___ water advantages and appurtenances to the same belonging or in any ___ as pertaining and the reversions remainders ___ ___ and profits thereof and all the estate right and title of him the said Dempsey Blythe of in and to the same To have and to hold the aforesaid granted and bargained promises with ___ of the appurtenances unto the said Thomas C. Jones his heirs and assigns in Trust forever and it is hereby declared to be the intent and meaning of these presents that if the said Dempsey Blythe shall punctually pay to the said Anthony M. Howell his heirs or assigns the said sum of two hundred seventy five dollars and interest aggreable to the time of the said Bond to the said Anthony M. Howell then the said Thomas C. Jones his heirs and assigns shall hold the said land and premises above granted to the sole and proper use and behalf of the said Dempsey Blythe and the said Thomas C. Jones covenants and agrees with the parties hereto taken care the said (sic) the said Dempsey Blythe his heirs Executors or administrators shall fail to make payment to the said Anthony M. Howell his heirs or assigns or before the first day of May 1834 the due on the Bond aforesaid that then the said Thomas C. Jones his heirs or assigns he the said Thomas C. Jones his heirs ___ ___ or assigns or ___ of them shall give thirty days notice and sell at public sale above mentioned tract of land and shall pay the money a___ there from to the said Anthony M. Howell his heirs or assigns so far forth as shall be their due and after satisfying the said Bond and interest and all the expenses remaining or arising from the notice and sale shall pay the surplus money to the said Dempsey Blythe or his assigns. Massenburg and Stephen Murdaugh Commissioners in chancery on the one part and Anthony M. Howell on the other part. Witnesseth that the said James D. Massenburg and Stephen Murdaugh by virtue of a decree of the County Court of Southampton and for and in consideration of the sum of four hundred and forty eight dollars for the payment whereof is secured by bond as the decree directed. Have bargained and sold and by these presents do bargain and sell unto the said Anthony M. Howell his heirs and assigns the tract of land whereof Newit Edwards dec'd seized containing one hundred and forty seven acres together with all the reversion and reversions remainder and remainders and every part and parcel thereof. This Indenture made and entered into the 28th day of November in the year of our Lord one thousand eight hundred and thirty five between Dempsey Blythe and Jincey his wife of the one part and Anthony M. Howel of the other part. Witnesseth that for and in consideration of two hundred and seventy five dollars current money of Virginia to them in hand paid by the said Anthony M. Howel, they the said Dempsey Blythe and        his wife have bargained and sold and by these presents do and of them bargain and sell unto the said Anthony M. Howel his heirs and assigns one certain tract or parcel of land containing by estimation seventy five acres be the same more or less being the tract formerly purchased by Dempsey Blythe of the aforesaid Howel and bounded as follows, beginning at a persimmon tree thence by a line of marked trees to a corner tree in the branch, thence up the branch to a sweet gum, thence by a line of marked trees to a corner pine, thence by a line of marked trees to Balay Drakes corner to a red oak Ridley Drakes corner thence to another corner tree and thence to the beginning and the reversion and reversions, remainder and remainders yearly and other vents issues and profits and every part and parcel thereof. To have and hold said tract of land with the tenements hereditaments, and all and s___ the premesis herein before mentioned or intended to be bargained and sold with every part and parcel thereof with every of their right members and appurtenances unto him the said Anthony M. Howel his heirs and assigns forever. This Indenture made and entered into this 9th day of January 1836 between James D. Massenburg, James Scott, and Jordan Edwards ___ Commissioners in Chancery on the one part and Anthony M. Howell of the other part. Witnesseth that the said James D. Massenburg James Scott and Jordan Edwards in consideration of the sum of two hundred dollars secured by him the said Anthony M. Howell as directed by a decree of the County Court of Southampton have granted, bargained and sold released and confirmed and by these presents do and each of them doth grant bargain and sell unto the said Anthony M. Howell his heirs and assigns forever all the tract or parcel of land of which Jordan Joyner ___ seized and and possessed containing ninety acres more or less it being the tract of land purchased by said Jordan Joyner from Amos Joyner and Nancy Joyner the particular whereof will appear by reference to their deed bearing date the 10th day of October 1821 and the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof. To have and hold the said tract of land with the tenements hereditaments and all and singular the premises herein before mentioned or intended to be bargained and sold with every part and parcel thereof with every of their rights ______ and appurtenances unto him the said Anthony M. Howell his heirs and assigns forever. And the said J. D. Massenburg James Scott and Jordan Edwards will warrant and ____ all right which they may lawfully convey under the aforementioned decree unto him the said Anthony M. This Indenture made and entered into the 22nd day of November 1837 between David Godwin of the first part Almarine A Delk of the second part, and Samuel P Nicholson Littleton R. Edwards, Amos Drewry & Etheldred E Briggs of the third part, all of the County of Southampton – Witnesseth that whereas the said Samuel P Nicholson, Littleton R. Edwards, Amos Drewry, and Etheldred E. Briggs have become security for the said David Godwin in two delivery bonds, one of the said bonds made payable to William B Harvey and the other to Stephen Murdaugh ____ of Randolph Edwards dec’d for the benefit of Anthony M. Howell and the said Godwin also stands justly indebted unto Samuel Briggs in the sum of fifteen dollars 95 cents by bond due the 24th November 1837 and the said David Godwin is anxious and desires to secure & indemnify his aforesaid securities from all loss or damage whatever in consequence of their security _____ aforesaid and to secure the said Sam’l P. Nicholson & Bernard & Briggs the sum of money respectfully due them hath for and in consideration of the promises aforesaid as well as for the further consideration of sum one dollar to him in hand ___ by the said Almarine A. Delk the receipt whereof is hereby acknowledged, granted, bargained & sold and by these presents do grant bargain & sell unto the said Almarine A. Delk, his executors & administrators, the following property to wit ~ One boy horse, one Buckskin or cream colored horse, one Barouche & Harness, one Negro woman named Peggy, one mare ___, & horse cart & wheels 1 ___ cutter, one hominy mill, 1 set ___ ___ & glass, 1 sofa,& 2 ____ tiny chairs, 3 wash stands, pitcher & bowls, 8 feather beds and furniture, 1 side board, 1 tent safe, 1 large mahogany table and every other article of household furniture belonging to the said Godwin. To have and to hold the said property unto him the said Almarine A Delk his executor or administrators to the only proper use and behalf of him the said Almarine A Delk his Executors and administrators forever. Upon this special Trust and confidence that the said David Godwin is to be permitted to the possession of the aforesaid property & the use and ____ thereof to take what the said Sam’l P. Nicholson Littleton R. Edwards, Amos Drewry & Etheldred E Briggs or a majority of them shall thank proper to ___ __ sale thereof for the purpose of paying the debts aforesaid for which they are security, or until the said Sam’l P Nicholson & Bernard & Briggs or either of them shall order the sale for the payment of the debts due them as aforesaid & the interest thereon. And upon this further trust, so soon as a sale shall be ordered as above provided for the said Almarine A. Delk (or in case of death for his legal personal representative who is hereby authorized to act) shall take possession of the said property herein before conveyed, and giving reasonable public notice of the time & place of sale, sell at public auction to the highest bidder for cash the property aforesaid and with the monies arising from such sale ___ pay all the necessary costs & expenses of such sale & this conveyance, then pay and satisfy the debts aforesaid for which the said Nicholson Edwards, Drewry & Briggs and securities and then pay & satisfy the debts herein before mentioned and the said Nicholson & Bernard & Briggs and if any surplus should then remain pay the same to the said David Godwin his Executors administrator or assigns. Howell of the County of Southampton of the one part & James Joyner of county aforesaid of the other part ___ that the said A. M. Howell for & in consideration of the full & just sum of three hundred dollars current money of Virginia to be paid by the said James Joyner to him in hand on or before the unsealing & ____ of these presents the receipt whereof the said A. M. M. Howell of in & to the said ___ every part thereof to have and hold the said plantation tact or parcel of land and premises aforesaid unto him the said James Joyner his heirs & assigns forever and the said A. This Indenture maid this ___th day of December 1837 between James Bradshaw of the County of Southampton of the one part and A. M. Howell of the said County of a second part and Stephen Murdaugh the aforesaid County of the third part. Witnesseth that whereas the said James Bradshaw stands indebted by bond to the said A. M. Howell in the sum of Three Hundred dollars, whereas for the further assurance of the payment it is agreed by the parties hereunto that a conveyance in trust shall be maid to the said Stephen Murdaugh for the benefit of the said A. M. Howell in case the said bond shall not be punctually paid with lawful interest thereon on or before the first day of January next. Now this indenture witnesseth that the said James Bradshaw for and in consideration of the promises and for the further sum of three hundred dollars to him in hand paid, the receipt of which is acknowledged has bargained and sold & by these presents doth for himself, his heirs executors administrators give grant bargain and sold unto the sd Stephen Murdaugh his heirs & assigns all that tract or parcel of land whereon the said James Bradshaw now lives lying in the said county of Southampton containing by estimation sixty one & a half acres be the same more or less also the personal estate belonging to the said James Bradshaw & bounded by the known and reputed bounds thereof & also all the buildings, woods, waters advantages & appurtenances to the same belonging or in any wise appertaining & the reversions remainders, rents, ___ & profits thereof & all the estate rights & title of him the said James Bradshaw of in and to the same. To have & to hold the aforesaid granted & bargained premises with every of the appurtenances

unto the said Stephen Murdaugh his heirs & assigns in trust forever & it is hereby declared to be the true intent and meaning of this presents that if the said James Bradshaw shall punctually pay to the said A. M. Howell his heirs or assigns the said sum of three hundred dollars & interest agreeable to the terms of the sd. bond to the sd. A. M. Howell then the sd. Stephen Murdaugh his heirs & assigns shall hold the said same and property & premises above granted to the sole & proper use thereof the said James Bradshaw & the sd. Murdaugh ____ & agree with the parties hereto that in case the sd. James Bradshaw his heirs Executors or administrators shall fail to make payment to the sd. A. M. Howell his heirs or assigns on or before the first day of January next the sum due on the bond aforesaid that then the said Murdaugh his heirs & assigns shall stand seized of the above granted & bargained premises for the purposes following that is to say that the request of the said A. M. Howell his heirs and assigns the said Murdaugh his heirs executors & administrators or assigns or either of them shall give twenty days notice & sell at public the above mentioned tract of land & property shall pay the money arising therefrom to the sd. A. M. Howell his heirs or assigns is far forth as shall be them due & after satisfying the sd. bond & interest & all the expenses remaining from the notice & sale shall pay the surplus money to the sd. Beale or the said Thomas Newsom his heirs executors and administrators or assigns set up and sell to the highest bidder for cash the aforesaid tract or parcel of Land and the said Negro man Davy ___ ___ much of the said property as will be sufficient to satisfy the said sum of three hundred and fifty dollars ___ ___ ____ thereon and the costs after giving Twenty days notice of the time and place of sale by advertisement to be posted in at least three public places in the neighborhood of the sale and out of the proceeds of the said sale pay the aforesaid sum of three hundred and fifty dollars with interest thereon and the cost of this indenture unto the said Thomas Newsom his heirs executors administrators or assigns and the balance if any after satisfying said debt interest and costs pay over to the said Willis E. This Deed made this 10th day of October 1857 between W W Briggs Trustee in a Deed of Trust executed by James J Williams To secure Jno M Gurley, A. M. Howell & others of the one part and Jno M Gurley of the other part. Witnesseth: that the said W. W. Briggs acting as Trustee under said deed did sell to the highest bidder on the 10th day of October 1859, The said Tract of land conveyed in said Deed of Trust and at the sale so made Jno M Gurley became the purchaser by bidding therefore the sum of three hundred dollars. Now this Deed witnesseth, that the said Briggs for the consideration of Three Hundred Dollars to him paid by said Jno M. Gurley doth Bargain and Sale from Abram Riddick to said Jas. J. Williams to him & his heirs forever only conveying to said Gurley such title to said Land as I held as Trustee aforesaid.

The defendant Eli Joyner who is out of this Commonwealth and against whom the plaintiffs seem to have proceeded in the mode presented by law against absent defendants having failed to appear and file his answer the bill of the plaintiffs is taken for confessed as to him: and the other defendants on whom the subpoena seems to have been executed and the bills of the plaintiffs filed more than four months and they having failed to comply and file their answers-and the several Scire facias in the cause having been regularly executed and yet on appearance made for the defendants the bill of the plaintiffs is taken for confessed as to all the Defendants.This cause came on to be heard on the original and amended bills whereto filed and was argued by Counsel. On consideration whereof the Court doth adjudge, order, and decree that the aforesaid Eli Joyner pay to the plaintiff Jason Butler seventy one dollars and sixteen cents with interest thereon from the 22nd day of November 1837 till paid, and that he pay to Anthony M. Howell one of the plaintiffs the sum of One hundred and sixty two dollars and eighty cents with interest theron from the 20th day of January 1834 till paid, and that he pay to the plaintiffs the costs in this suit expended. M. Howell and gray Edwards to be paid in part Satisfaction of the debt due to the said Jason Butler and that the Sheriff of this County sell to the highest bidder for cash ___ of the estate in the possession of Honor Daughtrey or her Committe to which she is entitled for her life under the will of THomas Daughtery and which one seventh part by the will of said Thomas Daughtrey belongs on the death of the said Honor Daughtrey to Charlotte Daughtrey who married Hillyard Holland and which one seventh has become the property of said Eli Joyner in remainder and out of the proceeds thereof pay first the costs of this suit and pay the amount due the plaintiffs after the application of the aforesaid bond-and the balance if any the Sheriff shall bring into COurt subject to the further order of this suit- But if the whole fund now decreed awards the satisfaction of the plaintiffs demands shall not be enough to discharge the same, then they shall be paid retrubly-But the plaintiffs are not to have the benefit of this decree until the plaintiffs or one of them or same one for them shall have filed in the Clerks Office of this COurt bond with good security in double the amount of their respective claims conditioned to to abide such further order as may be made for returning the effects of the absent defendant upon his appearance and answering the bill of the plaintiffs. But on such sale shall be made unless upon at least thirty days notice of the time and place of sale nor unless the Defendant Eli Joyner shall fail to pay the plaintiff for thirty days thier respective demand aforesaid together with the costs of this suit.

Matthew Mountford who stands bound by recognizance for his appearance here to answer the complaint of Baldy Mountford against him for a breach of the peace this day appeared in discharge of his recognizance and the said Baldy Mountford being sworn and examined and the said Matthew Mountford being fully heard it is the opinion of the Court & accordingly ordered that the said Matthew Mountford and do find scrutiny for keeping the peace for the term of 12 months from this day the said Matthew Mountford to be bound on a recognizance in the sum of $20 with two securities in the sum of $10 each and that he also pay the costs of this prosecution whereupon the said Matthew Mountford with Anthony M. Howell & Feilding I. Mahone his securities herein court severally acknowledge themselves indebted onto John M. Gregory Lieutenant Governor acting as Governor of the Commonwealth of Virginia that is today the said Matthew Mountford in the sum of $20 and the said Howell & Mahone in the sum of $10 each of their respective goods & chattel lands tenements to be levied & to the said Lieutenant Governor acting as Governor and his successors in the office of Governor to the use of the Commonwealth rendered. and it appearing to the Court that the Defendants have had legal notice of this
motion. they were solemnly called, but came not. therefore it is considered by
this Court that the plaintiff may have execution against the defendants for the
sum of seventy five dollars and fourteen cents the penalty of the said bond,
and his costs by him about his motion in this behalf expended. And the
said Defendants in Mercy of. But
this execution may be discharged by the payment of thirty seven dollars and
fifty seven cents with legal interest thereon from the 19th day of September

Page 5 -ABSTRACT-


Anthony M. Howell who stands charged in oath
by Fanny Warren, free single woman of this County with being the father of her
bastard child, this day appeared in Court in discharge of his recognizance and
thereupon the said Fanny Warren and sundry witnesses were summoned and examined
and the said Howell by his counsel fully heard. The Court after hearing the
testimony and from all the circumstances of the case, are of opinion and do
therefore adjudge the said Anthony M. Howell to be the father of the said
bastard child and that the said child is likely to become chargeable to the
County. THEREFORE it is ordered that the said Anthony M. Howell be charged with
the annual payment of Twenty Dollars for the space of seven years from the birth
of the said child to wit the 18th day of February 1843 and that he pay the same
annually to the overseers of the poor of this County from the said 18th day of
February 1843 to the full term of seven years in case the said child shall live
so long and that he also pay the costs of this prosecution. WHEREUPON the said
Anthony M. Howell with Harrison Joyner & Jethro Cobb his securities forever
consent severally acknowledging these themselves indebted unto the Commonwealth
of Virginia, that is to say the said Howell in the sum of one hundred and forty
dollars and the said Harrison Joyner and Jethro Cobb in the sum of seventy
dollars each to be levied of their respective goods & chattel lands,
tenements & the use of the Commonwealth rendered. Yet upon this condition
that if the said Anthony M. Howell shall observe & perform the order of the
County above against him then the above recognizance to be void or else to
remain in full force of & virtue.

This day comes the parties who being fully heard it is considered by the court that the said Ellsworth give the said Worrell administrator as aforesaid good ___ security according to Law the land for which purpose is to be in the penalty of two thousand dollars made payable to the said Worrell administrator as aforesaid and conditioned according to law. And that the said Ellsworth pay to the said Worrell Admst aforesaid his costs by him in this behalf expended. And thereupon the said Sebak Ellsworth with Benjamin Barrett, Augustis Pope and Anthony M.
